I Like Helping People. How Can I Help You?

Car And Truck Accidents

No one plans or expects to be involved in a car accident. Sadly, thousands of people are injured or killed each year in car wrecks on Texas roads and highways.

If you or a loved one has been injured in a car wreck, I will help you seek just and fair compensation for your medical bills, time off work, and noneconomic damages such as physical pain, mental anguish, physical impairment and disfigurement.

Since 2004, Templeton Law Firm has served clients in West and Central Texas and made insurance companies pay millions of dollars in fair and equitable settlement of these claims. I’m attorney Scott Templeton and I provide personal service and care in the following types of car wreck cases involving serious injury and wrongful death:

  • Negligence and driver error
  • Drunk drivers
  • Texting and driving
  • Pedestrians and bicyclists
  • Defective vehicles and tires
  • Speeding and reckless driving

Negligence And A Motor Vehicle Crash

Almost all car wreck cases that I take at the Templeton Law Firm involve some sort of negligence or driver error on the part of the offending or adverse parties and drivers. I see everything from traffic sign and signal violations to speeding, reckless driving, improper turns, rear-end collisions and the like. In these cases, the plaintiff must prove that the adverse parties were negligent, that their negligence caused the wreck, and that our clients sustained injury and damage in the wreck.

Under the law, negligence means a failure to use ordinary care, or a failure to do that which an ordinarily prudent person would have done under the same or similar circumstances. It is not an absolute or fixed standard and when a case is considered by a jury, that jury may determine different percentages of fault or negligence for all parties, based on the jury’s interpretation of the evidence.

If a case proceeds to trial, I may present evidence of negligence to the jury in the form of the police officer’s crash report, police officer’s testimony, photographs or videos, accident reconstructionist testimony and witness testimony. Once I establish the negligence of the adverse driver, I must show that the negligence caused injury and damage to our clients. This is normally done through the presentation of medical bills and records and live expert physician testimony to the jury.

If the client has lost or will lose money from a job because of injuries sustained in the wreck, I can present evidence of work history, tax returns, witness testimony, Social Security earnings and expert economist and vocational witness testimony, and the jury may award money damages for these past and future losses. Finally, the jury may consider and award money damages for any noneconomic damages such as physical pain, mental anguish, physical impairment or disfigurement.

Though many cases are settled with the negligent driver’s insurance carrier before trial, I prepare each case as if it will proceed to a jury trial. Such attention to detail and preparation sends a message to the liability insurance carriers that I’m an experienced trial lawyer prepared to present your case to the jury if need be.

If you or a loved one is involved in a car wreck and injured due to someone’s negligence or driver error, please contact me, and I will sit down with you and review your case to determine if I can be of service.

Trucking Accidents

When your vehicle is struck by an 18-wheeler, the damage and injuries are typically severe and devastating. Thousands of semi trucks run people over and crash into passenger vehicles each year on Texas roads and highways. These cases typically result in a totaled vehicle and the severe injury or wrongful death of the innocent passenger car driver and passengers.

We all know that truckers drive long hours into the night, are often compensated based on performance, time, and the number of loads delivered, and thus they have a huge incentive to stay awake as long as they can and run as many loads as possible in the shortest amount of time possible. Sadly, families and innocent people suffer and are injured or killed because of overworked, overtired employees of these trucking companies.

If you or a family member is a victim of such negligence or reckless driving, the Templeton Law Firm will empathize and understand your situation, and I will implement my knowledge, training and result-oriented strategies to obtain fair and reasonable compensation for your property or vehicle damage, medical expenses, lost earnings, funeral expenses, noneconomic damages and any other reasonably related damage stemming from the trucking companies’ reckless and unsafe driving practices.

These cases involve large corporate trucking companies and are more complicated than typical car wreck cases. Most times the 18-wheelers involved have GPS technologies or a “black box” which can pinpoint speeds, braking data, engine stress and other measures. These cases also involve state and federal highway regulations and laws. Hiring my law firm, the Templeton Law Firm, to represent you or a loved one in a trucking accident case will give you the necessary edge and arsenal to ensure that you are adequately protected, represented, cared for and awarded fair and sufficient compensation.
